Sometimes teenagers may find their parents so irritating that they may think about getting separated from them legally. This process is called emancipation and is usually a last resort for teenagers frustrated with irresponsible parents.
Emancipation is the procedure through which adolescents who are 14 through 17 years of age can become free from parental custody. By becoming emancipated, you forgo the right to be financially supported by your parents plus, you also get the right to make independent decisions and have control of most but not every aspect of your life.
However, there are some steps involved in the process, as the applicant teenager will have to prove to the judge that he/she has the capacity to live independently without help from their parents.
To get emancipated you should first get a full time job apart from proper
school education. This is one of the foremost requirements to satisfy.
You need to check whether you have enough skills to make a living. You
should be aware that teenage jobs are usually low paying, so you should
consider all such repercussions before applying for emancipation.
However, Emancipation is not the only option for troubled teenagers, as
there are several other options available to you if you don’t want to
live with your parents. Some of the options you have are:
• Looking for support from community and private organizations.
• An unofficial contract with your parents permitting you to live away
from your family residence.
• Arranging for family counseling or an intervention service between you
and your parents
• Living with a guardian. This can be any responsible adult that you can
trust. Example: grandparent, aunt, uncle, or other family relatives.
If you still believe that emancipation is the only way out, you can file
an application. The court has the right to approve or deny your application
even without a trial, but usually a hearing will be held. During the trial,
the judge will make sure that the emancipation is not opposing to the
best interests of the minor and will approve it only if all the requirements
have been met satisfactorily.
Emancipation is a complicated procedure and there are lots of conditions
to satisfy before getting a court decision. Also, it is not uncommon to
find teenagers wavering in their decision to get emancipated. So, it is
important to consider all the implications before you take the big step.
